Terms and conditions of online card payments acceptance

1. Introduction

1.1 Thank you for visiting Our website. This page tells You information about Us and establishes the legal terms and conditions (the “Terms”) upon which We are able to accept Your payment.

1.2 This page is important so You should read it carefully and make sure that You understand it and its implications before going any further. While proceeding online payment You should only indicate Your acceptance if You have read this page and all other policies it refers to and You are prepared to proceed an online payment.

1.3 If You do not accept these "Terms" then You will not be able to use the "Payment Gateway" to make a payment and You should contact Us for other options.

1.4 If You encounter any problems using this website or the "Payment Gateway" then You should contact Us immediately.

1.5 We are developing granted services. From time to time We may update these "Terms", and We will do reasonable efforts to bring any changes to Your attention. Consequently these "Terms" are subject to change at any time and each transaction shall be subject to the specific "Terms" valid at the time of the transaction.

2. Parties

2.1 In these Terms:

(a) “We” or “Us” or “Our” means ECO HOUSE Egypt, incorporated and registered in Egypt with company number #61898, whose registered office is at Office 1002, Omarat El Aalam 61, Agoza, Giza, Cairo, 12654;

(b) “You” or “Your” means you, being the person using this website to make a payment under "Contract".

(c) “Invoice” means the invoice that We have issued to You under "Contract" on behalf of ECO House with the detailed information about your order.

(d) “Web Policies” means the various policies and agreements regulation Your use of Our website, including but not limited with Our cookie policy, Our privacy policy, and Our terms of Website use.

3. Payment cards.

3.1 If You wish to pay Your Invoice by using either a credit or debit card then You must indicate this when asked to do so.

3.2 While making payment, such details of your order as its number, invoice number and number of payment document will be displayed in the payment form. Sum of payment will be automatically generated from invoicde. You do not need to enter any order details while making payment. However, you have to check the correctness of form filling before to confirm payment. .

3.3 Your payment is NOT processed by us. We provide only the data for payment of invoice. On the basis of the Invoice payment is processed by third party, online gateway provided by our Bank ("Payment gateway"). We have nothing to do with "Payment gateway" and do not control it and you need to read the terms and conditions that apply "Payment gateway" for payments.

3.4 We do not store, control or share any information that You entered in the "Payment gateway".

3.5 We believe that the "Payment gateway" provides a secure method of payment but we are not responsible for payments made through "Payment gateway". We exclude any liability for the actions of the "Payment gateway" and banks while making payments.

3.6. Payments are only accepted in Egyptian pounds. If your card is issued outside of Egypt, you should refer to "Payment gateway" and the Issuer of your payment card for more information about the terms on which payment will be made and charged to the possible Commission.

3.7. You don't have to use "Payment card" if you are not the owner, or you have no authority of the cardholder to use it.

3.8. "Payment gateway" will provide data about your made payment in the statement of your payment card like or similar "Payment for Eco House services".

4. Security

4.1 Security of Our website and "Payment gateway" is extremely important to us. To protect You and Your data when making a payment a number of security mechanisms has been implemented.

4.2 Before proceeding, you must ensure that the address of the web site starts with "https" and your browser confirm that you entered the safe zone. It usually displays as a lock icon appearing in your browser address bar.

5. Fees for card use

5.1. If you pay by credit or debit card (your "Payment card"), we may charge you a fee in addition to the amount of the invoice ("Fee") to cover fees for processing of payments.

5.2. We will inform You about the amount of "Fee" if any. This notice will be available even before You reach the "Payment gateway" based on the data You provide about the type of "Payment cards" that You intend to use.

6. Confirmation of payment

6.1 As soon As your payment is authorized, you will see the confirmation on the screen containing details of the transaction.

7. Our commitment

7.1 once we have received cleared payment from the "Payment gateway" on Your account and applied fee:

(a) We will process Your invioce and mark the stage of the transaction under the Contract as paid; and

(b) We will contact Your Manager to transfer transaction under the Contract to the next stage.

7.2. The time during which we need to get cleared payment from the "Payment gateway" depends on a number of factors. In most cases this will occur within 72 hours from the moment of payment and you will be responsible for the Invoice and all outstanding costs and interest (if any) during this time.

8. Refunds

8.1 Payments Refund is possible only within the first 3 hours after it is processed. You must inform us of the reason for the denial and make a written request for refund, and if this request is satisfied we will issue a rejection receipt of your funds for the "Payment gateway". All costs for the payment of a fee of the "Payment gateway" and banks are to be paid by You and will be deducted from the refund amount in the refund process.

8.2 Refunds for orders in the stages "Production" and later ones (under Contract) are not possible.

8.3 Refunds paid on closed orders, completed transactions for which You received the products and implemented the service, even in the case when You refuse from confirmation of receiving goods and rendered services is not possible.

9. Limitation of liability

9.1 Nothing in these "Terms" shall exclude or limit our liability for the quality of our services and products, and the timing, if it is not caused by the late payment of a specific stage of the Contract.

9.2 To the fullest possible extent permitted by law, we exclude all responsibility for any loss or damage, whether under the Contract, offense (including negligence), breach of legal duties or otherwise, even if foreseeable, arising under or in connection with :

(a) the use or the inability to use our site; or

(b) the use or the inability to use the "Payment gateway"; or

(d) Your failure to enter the correct payment details; or

(e) refusal of Issuer of your payment card to authorize the payment.

(f) loss of profits, sales, business or revenue;

(g) interruption of business;

(h) loss of anticipated savings;

(i) loss of business opportunity, goodwill or reputation; or

(j) any indirect loss or damage.

9.3 We are not liable for any loss or damage caused by computer viruses transmitted through the Internet, attacks resulting in "denial of service", or other technologically harmful or malicious material that may infect your computer equipment, computer programs, data or other materials are Your property, as a result of your use of Our site or downloading of any content on it or on any website linked to it.

9.4. We are not responsible for the content of sites linked to Our website, including the "Payment gateway" and a Bank. Links to other sites should not be interpreted as our endorsement of these sites and the responsibility for them. We are not responsible for any loss or damage that may arise from your use of the data from these sites.

10. The termination of these terms

10.1. If any court or competent authority decides that any provision of this agreement (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision to the extent required, be deemed to be deleted. However, the validity and applicability of the other provisions of this agreement will not be canceled.

11. Entire agreement

11.1. "Terms" and Our web policies constitute the entire agreement between you and us and supersede all previous drafts, arrangements relating to the subject matter of this agreement.

12. Rights of third parties

A Person who is not a party of the "Terms" shall not have any rights under or in connection with it.

13. Applicable law and jurisdiction

13.1 This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including disputes or claims outside the contract), shall be governed by and construed in accordance with the laws of Egypt.

13.2 the Parties irrevocably agree that the courts of Egypt shall have exclusive jurisdiction to settle any dispute or claims arising out of or in connection with this agreement or its subject matter (including disputes or claims outside the contract)
